Hello,

We would be very interesting to embed Helix and RealPlayer 10 in the Oralux CD. 

Oralux is a GNU/Linux audio distro for the vision impaired persons. 
The CD is not a commercial product, and can be freely downloaded from our website. 

Several cheap online sellers also propose the CD. We list them on the website since they help the person who can't download the CD (around 500 MBytes). 

Would it be possible to include for free Helix and RealPlayer in Oralux?

Hi,

I'm interested in licensing a Helix DNA Server for my commercial streaming 
use. I'd like to offer streaming services for my marketing clients/accounts 
and parallel to that, explore the possibilities for hiring third party 
developers to add functionality to meet my particular specifications. Would 
I be required to pay 500.00 per CPU royalty?

I would install and run Helix DNA Server on my server and stream Real Audio 
and Video from it for my clients. Does that qualify as "External 
Deployment" ? I see that definition in the Commercial RSPL but I don't see 
it as a definition in the RCSL.

If I am indeed allowed to license for the use I describe above, would I 
also be required to license the Add On Server Technology-RA/RV Server Code 
(so that I can stream RM files) in addition?  Would that be an additional 
500.00 royalty or is this included?

Am I correct in understanding that the only way to license the use of  Add 
On Server Technology-RA/RV Server Code is to sign a commercial RCSL, since 
that functionality is not available under a RPSL . Am I correct on this?

I also see that under a commercial RCSL, I would not be required to share 
my developments with Real but under RSPL I would. Do I understand this 
correctly?

Wade,  thanks for your email.  Here are the answers to your questions:

Q1) Would I be required to pay 500.00 per CPU royalty?
A1) Yes. However, you need only sign one copy of the Commercial 
Use 
Licenses  (Attachments D3.1 and F3.1)

Q2) Does that qualify as "External Deployment" ?
A2) Yes.

Q3) ..would I also be required to license the Add On Server 
Technology-RA/RV Server Code (so that I can stream RM files) in addition?
A3) Yes, the single $500/CPU is for the RA/RV/MP3   combined server.

Q4) Would that be an additional 500.00 royalty or is this included?
A4)  The $500/CPU is for Commercial Use of the RA/RV/MP3 server.   There is 
no extra royalty, unless you want to Advanced Server functionality that 
includes MP4, Windows Media, and numerous other carrier grade 
functions  (attachment F3.2)

Q5) Am I correct in understanding that the only way to license the use 
of  Add On Server Technology-RA/RV Server Code is to sign a commercial 
RCSL, since that functionality is not available under a RPSL . Am I correct

A5) Yes.  Correct, we have not dual licensed RealAudio/RealVideo support 
and therefore it is  only available under commercial licensing (RCSL).

Gilles, thanks for your email and for working  on such a worthy cause.

As you may know, we just went gold on both the 100% open source Helix 
Player and its superset the RealPlayer 10 for Linux.

Two things.

1) For web distribution, you can simply point your users to 
www.real.com/linux.  The RealPlayer 10 includes 
all of the functionality of the Helix Player and also includes playback 
support of RealAudio, RealVideo, MP3, Flash, etc and is a no-cost 
download.  Users that want only a GPL'd media player can freely download 
the underlying 100% GPL'd Helix Player right 
here.  Note, Oralux 
won't be listed supported Linux distro until it is qualified.  To  qualify 
Oralux, please work with our Linux Player QA Lead and the 
testing 
requirements.

2) For CD distribution.   We have a royalty free RealPlayer Contribution 
and Distribution Agreement.  However, as above, we are not allowing 
distribution until your platform is qualified.  We do not want to give our 
mutual users the impression that the products have been tested to work 
together, if they have not been qualified.  Distribution often infers 
qualification and this is the reason we are towing a hard line on  the CD 
distribution agreement.
